رئيس النيابة العامة: جائحة كورونا عقدت الجهود لتقليص الاعتقال الاحتياطي

قال مولاي الحسن الداكي الوكيل العام للملك لدى محكمة النقض رئيس النيابة العامة، إن ترشيد الإعتقال الاحتياطي يعتبر من أولويات تنفيذ السياسة الجنائية التي تشرف عليها رئاسة النيابة العامة،

واعتبر الداكي، خلال الندوة الجهوية حول “ترشيد الاعتقال الاحتياطي”، التي انعقدت أمس الاربعاء بالرباط.، أن تحريك الدعوى العمومية في حالة اعتقال يجب أن يتم في الحالات الاستثنائية التي يقع فيها مساس بمصالح أخرى من طرف المشتبه فيه، وذلك بتوفر المبررات القانونية المحددة في مواد قانون المسطرة الجنائية، والتي تتمثل بحسب قوله في حالة التلبس، وخطورة الفعل الجرمي، وانعدام ضمانات الحضور، وتوفر دلائل قوية على ارتكاب المشتبه فيه للجريمة.

وأضاف المتحدث نفسه، أنه رغم الجهود المبذولة في العمل على موضوع الاعتقال الاحتياطي، لا زالت نسبه في الارتفاع، حيث بلغ معدل الاعتقال الاحتياطي  44,56% في نهاية شهر أكتوبر 2021، علما أن هذه النسبة بلغت في نهاية شهر شتنبر 45,25%.

وبين رئيس النيابة العامة، أن جائحة كورونا عقدت الجهود الساعية لتقليص الاعتقال الاحتياطي حيث قال، إذا كانت جهود رئاسة النيابة العامة في البداية أثمرت نتائج طيبة عكستها الأرقام المسجلة في معدلات الاعتقال الاحتياطي، حيث انخفضت إلى 36,31%  في متم شهر مارس 2019، إلا أن الآثار السلبية التي أفرزها انتشار وباء كوفيد 19 على سير العدالة عموما، وعلى وثيرة البت في قضايا المعتقلين الاحتياطيين على وجه الخصوص، انعكست بشكل ملحوظ على نتائج سنتي 2020 و2021.
